Raminder Singh vs State of Punjab & Anr

Bench: 2 — Abhay Manohar Sapre

In Brief

The appellant, a Silt Observer, was promoted to Research Assistant Grade B in 2001 after fulfilling the prescribed eligibility criteria. However, the promotion was cancelled in 2002 on the ground that he lacked requisite qualifications. The Supreme Court held that the State's cancellation was unjustified. Since the Government had merged Grade C into Grade B without amending the Rules, the appellant's case had to be considered against the unamended Rules, which he satisfied. The Court restored the appellant to the promoted post and awarded back pay for the period when he performed the post's duties after cancellation.
