S.M. Pasha & Ors vs State of Maharashtra & Ors

Bench: 3 — M. R. Shah, C. T. Ravikumar, Sanjay Karol

In Brief

This Special Leave Petition arose from tenants challenging the termination of a development agreement affecting their occupancy rights in Maharashtra. During the proceedings, the original development agreement was terminated and a new one was entered into with another developer. The Supreme Court permitted some tenants to withdraw their petition given the changed circumstances, while disposing of the remaining petition with directions that the new development agreement's terms be shared with all tenants. The Court preserved the right of affected tenants to challenge the new agreement before an appropriate forum if they disagreed with its terms, and similarly preserved the original developer's right to challenge the termination. All pending applications were disposed of accordingly."
