Saraswati Singh and Ors vs Shailesh Singh and Ors

Bench: 3 — D.Y. Chandrachud

In Brief

The petitioners in a dismissed writ petition sought return of Rs 35 lakhs they had deposited with the Supreme Court Registry pursuant to interim orders—Rs 25 lakhs had been withdrawn by respondents and Rs 10 lakhs remained in a fixed deposit. The Court held that once litigation concludes, deposits made to test the petitioner's bona fides must be returned. The Court directed the Registry to return the Rs 10 lakhs with accrued interest, ordered respondents to refund the withdrawn Rs 25 lakhs within three weeks, and directed return of all title deeds deposited with the Court."
