Satluj Jal Vidyut Nigam vs Raj Kumar Rajinder Singh (Dead) Through Lrs. & Ors

Bench: 2 — Arun Mishra

In Brief

A Jagirdar claimed compensation for land acquired by the State under the Land Acquisition Act, despite the land having vested in the State under the Abolition Act and he having already received compensation twice under different statutes. The Supreme Court held that land not under personal cultivation vests automatically and immediately in the State under the Abolition Act, independent of compensation payment. The Jagirdar's multiple claims for the same land constituted fraud. The Court applied the principle that fraud vitiates every solemn act, even in collateral proceedings, and ordered refund of all wrongfully obtained compensation with 12% interest within three months.
