Saurabh Dwivedi and Ors vs Union of India (UOI) and Ors

Bench: 2 — Deepak Gupta

In Brief

This case involved a challenge to a High Court order that restricted post-graduate medical admissions and weightage benefits for in-service doctors. The Supreme Court held that the High Court exceeded its jurisdiction by raising issues not pleaded in the original writ petition and issuing directions affecting AMU and BHU without their involvement. The Court clarified that weightage under Regulation 9(iv) of the MCI Post Graduate Medical Education Regulations, 2000, must be available to all in-service doctors who served in remote areas, regardless of where they obtained their MBBS degree. Institutional preference up to 50% in central universities is permissible. The Supreme Court set aside the High Court's order and extended the deadline for admissions.
