Professor Rajendra Chaudhary & Anr vs State of Uttar Pradesh & Ors

Bench: 2 — L. Nageswara Rao

In Brief

Professor Rajendra Chaudhary and others challenged a 2015 advertisement for direct recruitment to 47 Professor posts in Uttar Pradesh Medical Colleges on two grounds: (1) the posts lacked reservations for Scheduled Castes, Tribes, and Other Backward Classes as required by law, and (2) the upper age limit was raised from 45 to 65 years in violation of service rules. The Supreme Court held that reservations apply department-wise, not across the entire cadre; since each department had fewer than five posts, no reservations were mandated. It also approved the age enhancement, finding that MCI Regulations governing medical education prevail over state service rules, and the increase addresses a critical shortage of qualified faculty. The appeals were dismissed.
