Shaji vs State of Kerala & Anr

Bench: 2 — Kurian

In Brief

The appellant was convicted under Section 326 IPC (causing grievous hurt by a dangerous weapon). The Supreme Court examined whether the prosecution had proved both essential ingredients of Section 326: voluntary causation of grievous hurt, and causation by a specified dangerous instrument likely to cause death. Finding that the second ingredient was not established by the evidence concerning the nature of injuries and the weapon used, the Court altered the conviction to Section 325 IPC (voluntarily causing grievous hurt). The appellant's application to compound the offence was allowed, with the sentence limited to the period already served.
