Shankar Yadav and Anr vs State of Chhattisgarh

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

This case concerns whether appellants convicted of causing hurt and grievous hurt (IPC sections 323, 324, 325) after 19 years of litigation could compound these offences following a compromise with the injured parties. The Supreme Court held that section 323 and 325 offences are compoundable when the injured person or their legal representatives enter into a valid compromise. For section 324 offences committed in 1998, the Court applied the law as it then stood (compoundable), not a later amendment making them non-compoundable. The compromise being valid and legal, the Court permitted compounding and acquitted the appellants, holding that compounding has the legal effect of acquittal."
