Shankar Yadav and Anr vs State of Chhattisgarh

Bench: 2 — Judge 1, Judge 2

In Brief

Appellants convicted of assault and hurt under Indian Penal Code sections 323, 324, and 325 sought permission to compound offences after 19 years of litigation following a compromise with the complainant and injured parties. The Supreme Court held that offences under sections 323 and 325 are compoundable by the injured party or their legal representatives. It also held that an offence under section 324 committed before the Criminal Law (Amendment) Act 2005 remains compoundable under the pre-amendment law. The Court permitted compounding, resulting in acquittal of the appellants as mandated by section 320(8) Cr.P.C.
