The Supreme Court dismissed an appeal challenging the High Court's compensation award of Rs. 23,115/- per kanal for 98 kanals of acquired land. The appellants sought enhancement based on the highest exemplar sale deed (Rs. 50,000/- per kanal). The Court held that the principle of awarding the highest comparable rate is subject to exceptions, particularly the extent of area. Since the exemplar sales were for small plots for private housing, while the acquisition was for a large area for a public housing colony, suitable deductions were permissible. The Court found adequate evidence on record supported the awarded compensation and rejected the claim for enhancement.
