Sk. Khabir was convicted along with others for the murder of two brothers during a violent mob attack in West Bengal in 1981. The appellants were armed with deadly weapons including swords, spears and lathis when they chased and fatally injured the brothers, while grievously injuring their companion. The Supreme Court upheld the conviction, finding that the eyewitness testimony was credible and fully corroborated by medical evidence showing wounds from sharp and blunt weapons. The Court rejected the defence argument that the eyewitness was unreliable merely because he was related to the deceased, as his evidence aligned with the FIR and post-mortem findings. The appeal was dismissed.
