Special Land Acquisition Officer, Kiadb, Mysore & Anr vs Anasuya Bai (D) by LRs. & Ors

Bench: 2 — A.K. Sikri

In Brief

The Supreme Court held that the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013 does not apply to land acquired under the Karnataka Industrial Areas Development Act, 1966, which is a self-contained code with its own acquisition and compensation framework. The Court found that the respondents did not consent to the compensation of Rs. 6,50,000/- per acre fixed by the Advisory Committee, as they were not served proper notice in the prescribed form. However, acquisition proceedings do not lapse merely for lack of an award, since under the KIAD Act, land vests by operation of law upon final notification, unlike under the general Land Acquisition Act. The Court restored the Single Judge's direction allowing the authorities to determine compensation afresh under Section 29 of the KIAD Act.",
