The State of Bihar challenged a High Court order directing compassionate appointment of two respondents in the regular State Government service. The respondents had accepted appointments as Nagar Shikshaks (municipal teachers) after statutory rules governing such appointments came into force. The Supreme Court held the High Court manifestly erred in directing regular service appointments contrary to the prescribed rules. The appeal was allowed and the High Court order set aside, though the respondents were granted liberty to seek suitable relief directly from the State Government.
