A widow sought retiral and family pension benefits for her deceased husband, a Public Works Department engineer who was promoted to Assistant Engineer but died before receiving these dues. The High Court directed the authorities to finalize benefits based on the promoted post's salary. The State appealed, arguing the promotion was never taken up and the employee remained absent for 13 years without joining. The Supreme Court held that absent disciplinary action or show cause notice, authorities cannot deny promoted post benefits on belated grounds. The High Court merely enforced its earlier order, not modified it. The appeal was dismissed.
