The widow of a deceased engineer sought her late husband's post-retirement benefits. He had been promoted from Junior Engineer to Assistant Engineer but passed away before receiving his retiral dues. The State contended he never joined the promoted post and remained absent for over 13 years. The High Court ordered his benefits calculated on the promoted post's salary. The Supreme Court held that absent contemporaneous disciplinary action, the widow was entitled to benefits of the promoted post. The court found the High Court merely enforced its earlier order rather than modifying it. Dismissing the State's appeal, the Court affirmed that authorities cannot circumvent judicial orders by releasing only partial benefits at lower rates."
