A widow challenged a High Court order awarding her family pension after her husband (a former Bihar Research Society employee) died while in government service. The State argued the husband was absorbed into government employment after 01.09.2005, when the Old Pension Rules were replaced by a new contributory scheme offering no pension benefits. The Supreme Court allowed the State's appeal, holding that employees absorbed post-2005 are governed by the New Contributory Pension Scheme, which provides no family pension. Since the deceased was absorbed in 2014 (effective 2009), he was not entitled to benefits under the Old Pension Rules, and neither was his widow.
