A widow claimed family pension following her husband's death in 2013, arguing she was entitled to benefits under the Old Pension Rules. Her husband had worked for Bihar Research Society before being absorbed into government service in 2009, after the Old Pension Rules had been abolished (31.08.2005) and replaced with the New Contributory Pension Scheme. The Supreme Court held that as absorption occurred after the scheme change, the husband was governed by the New Contributory Pension Scheme, which provides no pension or family pension. Prior service was not counted as government service. The Court allowed the State's appeal, quashing the High Court judgments that had granted family pension.
