State of Haryana & Anr vs Subhash Chander & Ors. …Respondent(s)

Bench: 2 — M.R. Shah, C.T. Ravikumar

In Brief

The State of Haryana challenged the High Court's decision awarding Rs. 2,98,54,720 per acre as compensation for approximately 58 acres of land acquired in village Kherki, Majra in January 2010. The High Court had applied a 12% enhancement to a base value of Rs. 2,38,00,000 per acre (determined for similar lands acquired in January 2008). The Supreme Court modified the award, reducing the enhancement from 12% to 10%, resulting in compensation of Rs. 2,87,98,000 per acre. The Court held that while enhancement between 8–15% is permissible, a 12% increase was imprudent given that land acquisition proceedings in the same village had commenced in 2008, potentially inflating prices artificially. The appeal was partly allowed.
