In Brief
The State challenged a High Court judgment that had reduced the accused's conviction from Section 307 (attempt to murder) to Section 324 (causing hurt) IPC. The accused had stabbed the complainant multiple times with a 4-inch knife near vital organs, causing a chest wound that damaged the lungs and other stab wounds on the back and hips. The Court held that intention to murder can be inferred from the nature of the dangerous weapon, severity of multiple blows, and location of injuries near vital organs—not necessarily the severity of actual injury. The lung injury from the chest wound was a vital organ injury. The Supreme Court set aside the High Court's judgment, restored the Sessions Court's conviction under Section 307, and upheld the 5-year sentence for the accused.
