State of Madhya Pradesh vs Harjeet Singh & Anr

Bench: 2 — Indu Malhotra

In Brief

A man stabbed another with a 4-inch knife, inflicting multiple wounds to the chest, back, and hips. The High Court reduced the conviction from attempt to murder (Section 307 IPC) to voluntarily causing hurt (Section 324 IPC), arguing the injuries were on 'unimportant' body parts and there was no stated intention to kill. The Supreme Court reversed this, holding that the intention to commit murder can be inferred from the weapon used, severity and location of blows, and circumstances, without requiring an explicit statement of intent. Multiple stab wounds to vital organs with a dangerous weapon ordinarily lead to death and satisfy Section 307. The Court restored the 5-year sentence for the main accused but confirmed acquittal of the second accused due to inconsistent eyewitness testimony about his role.
