Premchand was convicted of murdering Nandkishor Korde and attempting to murder three others during an altercation on 26 September 2013 in Katol, Maharashtra. He received life imprisonment. The Supreme Court allowed his appeal, finding that the trial court failed to properly consider his written statement filed under section 313 CrPC explaining the circumstances. The Court held that the death occurred during a sudden, unpremeditated quarrel without prior targeting of the victim, who was not the initial aggressor. Having already served over nine years imprisonment, the Court converted his conviction from section 302 (murder) to section 304 Part II IPC (culpable homicide not amounting to murder) and ordered his immediate release, finding such incarceration adequate punishment.
