A widow sought regularization of her work-charge employee husband's services twelve years after his death in 2005 to claim family pension. The High Court directed regularization one day before death. The Supreme Court reversed this, holding that the deceased was not entitled to regularization as his turn had not come in the seniority list at the time of death. The Court held that regularization must follow the prescribed policy based on seniority and vacancy, not post-mortem judicial directions. The State's appeal was allowed and the High Court orders were quashed.
