The State of U.P. appealed a High Court order directing reconsideration for appointment of Chunni Lal to the post of Deputy Collector. The High Court had quashed the rejection of his representation but directed appointment without disturbing Ajay Shankar Pandey's appointment to the same post. The Supreme Court held this direction legally untenable—two persons cannot occupy one post. Additionally, Chunni Lal had retired on superannuation before the appeal concluded, rendering implementation impossible. The Court quashed the High Court's judgment as unsustainable and impractical.
