This case concerned whether employees of a merged organisation were entitled to benefits under the Career Advancement Scheme (CAS) 1990 and Modified Career Advancement Scheme (MCAS) 2001. The State of West Bengal argued that employees received adequate compensation through higher pay-scales upon merger, and were therefore ineligible for CAS/MCAS. The Supreme Court held that employees must be granted CAS/MCAS benefits equivalent to other government employees. To prevent double payment, amounts previously received under the merger scheme were to be adjusted against the new CAS/MCAS entitlements. The State was directed to implement the order within two months.
