The State of West Bengal appealed against a decision involving pay fixation of employees of a merged organisation. The employees claimed they were denied the benefits of the Career Advancement Scheme (CAS) and Modified Career Advancement Scheme (MCAS) because they had received higher pay-scales as part of a merger. The Court held that employees are entitled to CAS/MCAS benefits on the same basis as other government employees. Amounts already paid under the merger scheme shall be adjusted when settling monetary claims under CAS/MCAS. The appeal was disposed accordingly.
