Subhan Tours & Travel Services vs Union of India

Bench: 2 — Abhay Manohar Sapre

In Brief

Multiple private tour operators filed writ petitions seeking mandamus to compel authorities to accept their applications and grant registration certificates to conduct Hajj tours in 2016. The operators claimed they were qualified and had previously conducted successful Hajj tours without any blemish. The Government's counsel represented that no final decision had been taken on any application. The Supreme Court disposed of the petitions by directing each petitioner to submit fresh applications with complete details and prescribed documents by 27 May 2016, and requiring the competent authority to examine and decide each application on individual merits with reasoned orders by 29 June 2016.
