In Brief
The Surat Municipal Corporation sought to acquire land from a private owner to construct a Sewage Treatment Plant. The owner contested the acquisition. The Supreme Court held that instead of receiving monetary compensation under the Land Acquisition Act, 2013, the owner could receive rehabilitation through allotment of an appropriate residential plot. The Court directed that such plot be allotted before any other scheme allotments, and ruled that no monetary compensation would be paid in light of this rehabilitation. The appeal was allowed.
