Vijay Latka and another challenged a land acquisition notification and award issued by Haryana authorities. The High Court dismissed their writ petition on the ground that no challenge is maintainable after an award is passed. On appeal, the Supreme Court held that since no compensation was paid despite an award dated 31.10.2005, the acquisition proceedings had lapsed under Section 24(2) of the 2013 Act. The Court clarified that the requisitioning authority has a statutory duty to pay compensation; the land owner need not approach the authority to collect it. The appeal was allowed and the acquisition proceedings set aside as lapsed.
