Surinder Kumar Bansal & Anr vs Vishranti City Residents Welfare & Ors

Bench: 2 — Kurian

In Brief

In this appeal, the Supreme Court addressed the procedural fairness issue concerning the rejection of applications for impleadment by the High Court. The appellants had been adversely affected by High Court orders but were denied a hearing before those orders were passed. The Supreme Court held that it was just and proper to implead the appellants in the pending High Court proceedings and afford them a hearing on the matters in the disputed orders. The Court set aside the orders dismissing the impleadment applications and directed the High Court to conduct fresh proceedings expeditiously, maintaining interim relief granted to the appellants. The appeals were allowed on procedural grounds without comment on the merits.
