In Brief
This writ petition challenged amendments to Regulation 9 of the Post Graduate Medical Education Regulations, 2000, affecting admissions for postgraduate medical courses and implementation of the Rights of Persons with Disabilities Act, 2016. The petitioners, Tamil Nadu Medical Officers Association and others, contested whether States could provide reservation for in-service medical officers and whether recent amendments were constitutionally valid. The Court found that key constitutional questions regarding legislative competence under the Seventh Schedule had not been adequately addressed in the prior Dinesh Singh Chauhan judgment. Accordingly, the Court remitted the matter to a larger Bench for comprehensive consideration of these issues and the urgent question of interim relief, as counseling had commenced or was about to commence in various States."
