The Supreme Court upheld the Union Public Service Commission's decision to exclude an IAS officer from a promotion Select List despite his eligibility. The Court held that mere eligibility does not automatically entitle an officer to inclusion in the list; decisions must be based on comparative merit and overall service record within the statutory size limits of the Select List. The Selection Committee's process was not arbitrary, as officers with higher grading were available and selected instead. The appeals by UPSC were allowed.
