Supreme Court of India 2017-11-22 disposed

V. Lakshmikanthan and Anr vs Union of India and Ors. etc

Bench: 2 — Kurian

In Brief

The Supreme Court considered whether Railways must apply post-based roster principles for promotions from the date specified by earlier decisions (10.02.1995) or from when Railways later implemented it (16.11.2005). The Court held that Railways must follow post-based roster principles from 10.02.1995 as directed in prior Supreme Court judgments, regardless of the later implementation date chosen by Railways. The appellants' cases were remitted for examination under these principles, with directions for notional promotion and seniority restoration where eligible, without disturbing promotions already granted to others.
