V. Lakshmikanthan and Anr vs Union of India and Ors. etc

Bench: 2 — Kurian

In Brief

This civil appeal concerns the correct effective date for implementing post-based roster principles for Railway promotions. While the Supreme Court directed in R.K. Sabharwal (1995) that post-based roster must apply from 10.02.1995, Railways delayed implementation until 16.11.2005. The Court held that post-based roster principles must apply from 10.02.1995 as originally directed, and set aside the Railways' delay. It directed re-examination of appellants' promotions to Assistant Executive Engineer and Executive Engineer using correct seniority rules, while protecting existing promotions of others.
