Vandana Tyagi vs Apeejay Saraswati P.G. College for Girls & Ors

Bench: 2 — Kurian

In Brief

The appellant, a college Principal, sought relief from an interim order restraining her from performing her duties while a Letters Patent Appeal (LPA) was pending in the High Court. The Supreme Court found the LPA was ready for hearing and directed the High Court to dispose of it expeditiously, ideally before summer recess. Pending that decision, the Court restrained the college management from permanently filling the Principal's post to maintain status quo. The parties were permitted to raise all legal contentions, including the LPA's maintainability, before the High Court. The appeal was disposed accordingly.
