A teacher who refused promotion to a rural posting in 2007 was later charged under amended promotion rules introduced in January 2010. The Supreme Court held that rules cannot be applied retroactively. Since the alleged misconduct (refusing the 2007 promotion) occurred before the amended rules took effect, the teacher could not be disciplined under them. The Court set aside the Division Bench's judgment that upheld the penalty, and restored the Single Judge's decision quashing the disciplinary action.
