In Brief

The Bangalore Development Authority sought to challenge a High Court judgment that had applied the 2013 Land Acquisition Act to its peripheral ring road project around Bangalore. The Supreme Court clarified that the Land Acquisition Act 1894 is incorporated into the BDA Act by legislation by incorporation, not by reference. Consequently, when the 1894 Act was repealed by the 2013 Act, the BDA Act remained unaffected. The Court held that the 2013 Act's provisions do not apply to acquisitions under the BDA Act, as Section 24 of the 2013 Act applies only to acquisitions initiated under the 1894 Act itself. The High Court's judgment was overruled.
