C/M KISAN INTER COLLEGE MANAGER vs THE STATE OF UTTAR PRADESH

Bench: 2 — L. Nageswara Rao, Hemant Gupta

In Brief

A college manager challenged the regularization of an L.T. Grade Assistant Teacher (Maths) appointed in 1984 after initially denying him service benefits. The Supreme Court upheld the teacher's regularization, finding that a detailed independent enquiry confirmed he worked continuously from 1985 onwards, the college's own records acknowledged his service, the Government supported regularization, and he satisfied the statutory 10-year service requirement under the U.P. Secondary Education Services Commission Act, 1982. The Court dismissed the college's appeal as it had no reasonable grounds to dispute the teacher's service record."
