Delhi Development Authority vs Charanjit Kaur and Ors

Bench: 2 — Kurian

In Brief

The Delhi Development Authority appealed dismissals of land acquisition proceedings against original landowners. The Supreme Court dismissed the appeals, holding that they were governed by prior judgments. The Court granted the Authority a one-year period to initiate fresh acquisition proceedings under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. If no fresh acquisition is commenced within one year, the Authority must return physical possession of the land to the original owners.
