Ghanshyam & Anr vs State of M.P. & Ors

Bench: 2 — Anil R. Dave

In Brief

Ghanshyam and another challenged land acquisition orders. The Supreme Court upheld the High Court's decision to grant them liberty to approach the concerned Authority under Sections 5A and 48 of the Land Acquisition Act, 1894, and extended the deadline by one month. The Court directed that if rights have accrued under the Land Acquisition, Rehabilitation and Resettlement Act, 2013, Section 24(2), appellants should file a substantive writ petition in the High Court. The appeals were disposed without considering merits, with no costs awarded. Any adverse High Court order would be subject to further Supreme Court appeal.
