Habib Khan vs State of Uttarakhand & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Three public servants challenged High Court orders denying them credit for work-charged service when calculating pension-qualifying service under Uttarakhand civil service rules. The Supreme Court held that work-charged service periods must be counted toward qualifying service for pension purposes. Relying on its precedent in Punjab State Electricity Board v. Narata Singh (2010), which struck down a similar exclusionary rule in Punjab, the Court found that distinguishing between temporary/officiating service and work-charged service was unjustifiable discrimination. The Court allowed the appeals, set aside the High Court orders, and directed the State to grant all consequential pension benefits without delay.
