U.P. Secondary Education Service Selection Board vs State of U.P. & Ors

Bench: 2 — Kurian

In Brief

The U.P. Secondary Education Services Selection Board sought clarification regarding its powers to accommodate selected teaching candidates who could not initially be placed due to lack of vacancies. The Supreme Court held that the Board has the authority to accommodate such candidates in available or arising vacancies in accordance with the amended Rule 13 of the 1998 Rules. The Court clarified that the Board's accommodation powers are not limited only to vacancies notified in the same advertisement but extend to any subsequently available or notified vacancies. The appeals were disposed of with directions to clarify the impugned reference order accordingly.
