In Brief
The U.P. Secondary Education Service Selection Board had issued a reference order interpreting Rule 13(5) of the 1998 Rules narrowly, limiting accommodation of selected candidates only to vacancies under the same advertisement. The Supreme Court clarified that the Board has the power and duty to accommodate selected candidates who could not initially join due to lack of vacancies in any available or arising vacancies. The Court held that the Board cannot deny accommodation indefinitely; selected candidates must be adjusted when vacancies become available, following the amended Rule 13 procedure whereby the District Inspector recommends adjustments to the Board.
