Malik Industry challenged land acquisition proceedings on the ground that compensation had not been paid to them but merely deposited with the Land Acquisition Collector. The Supreme Court held that under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, acquisition proceedings lapse when actual compensation payment is not made. The Court allowed the appeals, declared the acquisition lapsed, but permitted the State to initiate fresh proceedings within six months.
