Delhi Development Authority vs Shashi Kant Goenka and Ors

Bench: 2 — Kurian

In Brief

Delhi Development Authority appealed against an order concerning abandoned land acquisition proceedings. The Supreme Court dismissed the appeal, as the legal issue was already settled by prior precedent (Civil Appeals from 2015–2016). However, in view of the case's circumstances, the Court allowed the DDA a six-month grace period to restart acquisition proceedings under Section 24(2) of the RFCTLARR Act, 2013. If no fresh proceedings were initiated within that period, the DDA was required to return physical possession of the land to the owner.
