Manoj Kumar Sharma & Ors vs State of Chhattisgarh & Anr

Bench: 2 — R.K. Agrawal

In Brief

A woman married to an Air Force officer died by hanging in her matrimonial home in Ambala, Haryana in 1999. Initial investigation concluded no foul play. Five years later, her brother filed an FIR at Durg, Chhattisgarh alleging dowry-related cruelty and abetment of suicide, based on anonymous letters. The Supreme Court quashed the FIR, holding: (1) the initial inquest inquiry under Section 174 is distinct from investigation under Section 154 and does not bar a later FIR; (2) however, the Durg court lacked territorial jurisdiction since the entire offence occurred in Ambala; (3) the extraordinary 5-year delay, anonymous letters, vague allegations, and prior family acquiescence rendered the prosecution an abuse of process under Section 482 CrPC.
