In Brief
The Supreme Court disposed of a special leave petition challenging the Ministry of Health's decision to debar a medical college from admitting MBBS students for two years and encash its bank guarantee. The Court held that the institution was entitled to fair process: students already admitted on conditional permission must be allowed to continue, fresh inspections must be conducted, the institution given time to cure deficiencies, and the Ministry must decide within one month based on MCI recommendations and a prescribed hearing committee framework. The bank guarantee must remain live until final decision. The institution's 2017-18 renewal application was treated as one for 2018-19 and must be processed promptly.
