The appellant wife and respondent husband, both legally trained, had been granted a mutual consent divorce decree. The appellant challenged an order finding the respondent in contempt for allegedly violating the settlement. Both parties appeared before the Supreme Court expressing a clear desire for peace and to end all litigation. The Court held that the purpose of a mutual consent divorce is to allow parties to part as friends. Finding that both parties wished to honour their settlement, the Court quashed related criminal proceedings and restrained both parties and their families from instituting any further case or complaint against each other without the Court's permission. The appeal was allowed.
