Radhey Shyam Pandey was appointed as a clerk in 1963 and later worked as a stenographer from 1976 onwards, but continued to receive only the salary of a clerk. After centralization of stenographer services in 1984, the State Government became the appointing authority. The Tribunal awarded him arrears of salary as a stenographer, but the High Court set aside this order solely because the State Government had not been made a party. The Supreme Court allowed the appeal, holding that while the procedural defect needed to be cured by impleading the State Government, the High Court should have considered the merits. The case was remitted to the High Court for fresh adjudication after proper impleading of the State."
