Ratti Ram vs Union of India & Anr

Bench: 2 — Kurian

In Brief

In a land acquisition case, the Court fixed the land value at Rs. 76,550 per Bigha but the lower court denied statutory interest benefits for a period when reference proceedings were stayed at the appellant's instance. The Supreme Court held that statutory benefits under Section 28 of the Land Acquisition Act, 1894 cannot be denied merely because proceedings were stayed. The Act contains no exclusion for any period, and interest runs from the date of dispossession. The Court allowed the appeal and directed payment of interest on the enhanced compensation for the entire period, including the stay period."
