S.R. Raju vs State of Karnataka Thr. SHO and another

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellant was convicted under Section 324 IPC (voluntarily causing hurt) for assaulting a victim with an iron rod. The trial court sentenced him to one year rigorous imprisonment and fine; the High Court reduced this to one month simple imprisonment and Rs. 25,000 fine. The Supreme Court allowed the appeal, holding that the High Court erred by not considering that the parties had compromised and reconciled. While Section 324 IPC was not technically compoundable under law at the time of the 2005 incident, the court found that the settlement between the parties should have been given significant weight in sentencing, warranting reversal of the High Court's order.
